Foreclosure Process The Arizona foreclosure process is a non-judicial (No Judge) and simple procedure for your lender. Foreclosure is the legal process by which a bank can obtain legal title and ownership of your property. It relinquishes your interest in the property and waives any rights to the property and gives the courts the ability to legally evict the homeowner from the premises. In Arizona, a lender must appoint its trustee, which is the law firm who holds title and has the legal right to sell the home in a (Auction) trustee sale and handle the appropriate paperwork. By law, the trustee must make public record of "Notice of Trustee's Sale" in the county recorders office. The home is to be sold 90 days from the recording date of the notice. This notice will be published once a week for four consecutive weeks in a "newspaper of general circulation" in that county. The homeowner will mail a notice within five days of the recorded notice of trustee sale to the home and other parties on title.
